Answer
Where there is no union, the employer must attempt to identify the individuals who will finally lose their jobs as a result of the bumping system. If the employer cannot reasonably identify these workers, it must give notice to the incumbent workers in the jobs being eliminated. When providing notice to a union representative, it is not necessary for the employer to identify bumpees. The employer must, however, identify the positions affected by the closing or mass layoff.
